Terms of Service

1. Acceptance of Terms

By accessing and using Executive Applications ("the Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Executive Applications is a SaaS platform that helps users:

• Upload and manage CVs/resumes
• Analyze job descriptions
• Match their qualifications with job requirements
• Track job applications

3. User Accounts

To use the Service, you must:

• Create an account using Google OAuth or email authentication
• Provide accurate and complete information
• Maintain the security of your account credentials
• Be at least 16 years of age
• Notify us immediately of any unauthorized use

4. Subscription Terms

4.1 Billing

Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as explicitly stated in these terms.

4.2 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period.

4.3 Refunds

Refunds may be provided at our sole discretion within 14 days of initial purchase. Refund requests should be submitted via email to [email protected].

4.4 Price Changes

We reserve the right to modify subscription pricing with 30 days' notice. Existing subscribers will be grandfathered at their current rate for one billing cycle after the notice period.

5. Acceptable Use Policy

You agree not to:

• Upload malicious files, viruses, or harmful code
• Use the Service for illegal purposes
• Attempt to gain unauthorized access to our systems
• Scrape, crawl, or automate access to the Service
• Share your account with others
• Reverse engineer or attempt to extract source code
• Upload content that infringes on intellectual property rights
• Use the Service to harass, abuse, or harm others

6. Intellectual Property Rights

6.1 Your Content

You retain all rights to the content you upload (CVs, job descriptions, etc.). By uploading content, you grant us a limited license to process, store, and analyze your content to provide the Service.

6.2 Our Content

The Service, including its design, features, and functionality, is owned by Executive Applications and is protected by copyright, trademark, and other intellectual property laws.

6.3 AI-Generated Analysis

Analysis and matching results generated by our AI are provided to you for your personal use. You may use these results for your job search activities.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The Service is provided "AS IS" without warranties of any kind
• We do not guarantee job placement or interview success
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid in the last 12 months
• We are not responsible for the accuracy of AI-generated analysis

7a. AI-Generated Content and Liability Disclaimer

7a.1 Nature of AI-Assisted Service

Executive Applications is an AI-assisted tool designed to support your job application activities. The platform uses artificial intelligence (Large Language Models) to analyze CVs, generate documents, and provide recommendations. You acknowledge and accept that:

• AI technology has inherent limitations and cannot guarantee error-free results
• All AI-generated content should be understood as suggestions and starting points, not as final, ready-to-use documents
• The AI may generate information that is inaccurate, incomplete, or unsuitable for your specific situation
• AI-generated content does not constitute professional career advice, legal advice, or recruitment services

7a.2 User Responsibility

You are solely responsible for:

• Reviewing, editing, and approving all AI-generated content before use
• Ensuring the accuracy of all information contained in generated documents
• Making the final decision on whether to use or not use the generated content
• Adapting the generated content to your individual circumstances and requirements
• Complying with all applicable laws and regulations when using the generated content

7a.3 No Guarantee of Success

Executive Applications does NOT guarantee:

• Receipt of job interviews or job offers
• Suitability of generated content for specific positions or employers
• Successful passage through Applicant Tracking Systems (ATS)
• Specific outcomes or success rates in job applications
• Completeness or currency of company information

7a.4 Disclaimer of Liability for AI-Generated Content

To the fullest extent permitted by law, we disclaim all liability for:

• Direct or indirect damages arising from the use of AI-generated content
• Lost employment opportunities or career prospects
• Errors, inaccuracies, or omissions in AI-generated documents
• Consequences resulting from submitting AI-generated content to employers
• Reputational damage resulting from the use of generated content

Note: The statutory rights of consumers under applicable law remain unaffected. Liability for damages arising from injury to life, body, or health, as well as in cases of intent and gross negligence, remains unlimited.

7a.5 Consent and Acknowledgment

By using the Service, you confirm that you:

• Have read and understood these limitations
• Accept that AI-generated content must be reviewed before use
• Assume sole responsibility for the final use of all generated content
• Understand that the Service is an assistive tool and does not replace professional advice

8. Data Processing and AI Providers

We use Supabase for data storage, Google OAuth for authentication, and AI technology for CV and job analysis. Your use of the Service constitutes consent to data processing as described in our Privacy Policy.

8.1 AI and Data Providers

Our platform utilizes the following service providers:

• Anthropic Claude API: Used for CV analysis, document generation, job matching, and web research
• Bright Data: Used exclusively for collecting publicly available job posting information

8.2 Data Separation

Your personal documents (CVs, cover letters, personal information) are NEVER shared with Bright Data. This service is used solely for collecting publicly available job descriptions. All personal document processing is handled exclusively through Anthropic's Claude API.

9. Dispute Resolution

9.1 Informal Resolution

Before filing a claim, you agree to contact us at [email protected] to attempt to resolve the dispute informally.

9.2 Arbitration

Any disputes not resolved informally shall be resolved through binding arbitration in accordance with the rules of the International Chamber of Commerce.

9.3 Governing Law

These terms shall be governed by and construed in accordance with German law, excluding its conflicts of law provisions.

10. Service Modifications and Termination

10.1 Service Changes

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.

10.2 Account Termination

We may terminate or suspend your account if you:

• Violate these Terms of Service
• Engage in fraudulent activity
• Fail to pay subscription fees
• Request account deletion

10.3 Data Retention After Termination

Upon account termination, your data will be deleted within 30 days, except as required by law or for legitimate business purposes.

11. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of material changes via email or through the Service. Your continued use after changes constitutes acceptance of the new terms.
